TERMS AND CONDITIONS


THE SERVICES WE PROVIDE AND COVER: The service contract is between the customer and HEATSPAN. This plan is available to residential homeowners located in one to three family houses. The plan provides coverage for (a) ONE gas fired central heating equipment with an hourly output no greater than 300,000 BTU’s covering no more than three heating zones. (b) one gas or electric water heating equipment with an hourly input no greater than 95,000 BTUs or (c) one gas fired hot water boiler 0r (d) one steam boiler. All equipment must meet state and local installation codes. HEATSPAN offers three different plans, each of which can be selected by checking the appropriate box (es) on the accompanying page. The parts covered in packages B and C are listed below.


• WHEN SERVICE STARTS: Coverage under each plan will commence 15 days after HEATSPANS receipt of payment and will continue until customer cancels the plan in writing. The equipment must be in good operating condition on the day the plan takes effect. The plan does not cover pre-existing conditions. HEATSPAN reserves the right to make an on sight inspection of the equipment before accepting the equipment for coverage under the plan


• HOW TO GET SERVICE: Customers can call toll free 718-375-3320. Our phone lines are open 24hrs 7 days a week. HEATSPAN will attempt to respond to service requests promptly, with the exception of situations beyond heatspans reasonable control as noted in the following paragraphs


• ONE YEAR WARRANTY: Heatspan warrants the equipment to the extent and subjects to the limits of the warranty provided by the manufacturer. Heatspan warrants that to the extent warranted by the manufacturer, all parts supplied by Heatspan under the plan will be free of defects in design and workmanship. In addition should any services or parts provided by Heatspan prove defective during a one year period following the performance or installation, Heatspan, at its option, either repair, or replace or will issue a credit for any such parts or services: provided that the defect was not caused in any way by the customer or any other person.


• This warranty is expressed in lieu of any and all warranties, expressed or implied. Heatspan makes no warranty that such parts are merchantable or fit for any particular purpose and Heatspan has made not warranties, affirmation of act or promised, either expressed or implied, which extend upon the face of this agreement. Heatspans obligation to repair, replace, or issue credit for any defective part or service shall be customers exclusive remedy under this agreement.


• CUSTOMERS RIGHT TO CANCEL PLAN: Customer has the right to cancel their plan by written notice sent to Heatspan with-in twenty days from the date customer returns the signed enrollment form to Heatspan. Customer’s written notice of cancellation must be sent to the following address: Heatspan Customer Care, 1980 east 35th street BKLYN N.Y. 11234. If customer has made no claim with-in the twenty day period, the plan shall be void and all monies will be returned to customer within thirty days of Heatspans receipt of written notice.


• OUR RIGHT TO CANCEL PLAN: Heatspan reserves the right to cancel plan if customer fails to provide access to equipment, if customer fails to service or replace any parts necessary to maintain the equipment in good working order, or if Heatspan determines that the equipment is unserviceable at the time of Heatspans first inspection of the equipment, the equipment doesn’t qualify under the plan, there are unsafe working conditions at customer’s premises, or the equipment isn’t being used for its design purpose. If the plan is cancelled for any of the above reasons Heatspan will refund the plan price paid, less the cost of any service and parts provided by Heatspan.


• CONDITIONS BEYOND OUR CONTROL: Heatspan is not responsible for any delays caused by its failure to obtain necessary parts or render appropriate services on account of or due to weather conditions, governmental entities, strikes or other labor difficulties, acts of war, or other causes beyond Heatspans control.


• PARTS COVERAGE: a complete list of parts covered by this agreement is found here- Aquastat and wells, Automatic water feeder, A & B valves, barometric diverters, belts, blower motors, burner motor, belt drive blower, capacitors, circulator motor, circulator pump, clutch coupling, and impeller(limit 2), Direct drive blower wheel (no bearings). Drain-off valves, drain valve on low water cut-off, electrical switch(house heater only), electrical water heating element, electronic spark pack, extrol tanks, Fan and limit controls, filtrol tanks, flame rollout switch, flame sensors, flame spreaders, flue pipe sleeves, gas controls, gas valves, gauge glass and washers, generator leads, horizontal diverters, limit controls, low water cut-off, motorized flue damper, pigtail, pilot burner, pilot safeties, pilot tubing, “B” vent pipe, pressure differential switch, pressure gauge, pressure relief valve, regulators, relays, spark electrodes, spark wire, spill switch, steam pop safety valves, steam pressure control, T&P relief valve, thermocouple, vertical diverters, zone valve heads. Interchangeable parts will be used when exact parts are not available. Guaranteed rebuilt/manufactured parts may be used at Heatspans discretion. All such rebuilt/manufactured parts will be covered by the warranty included. Heatspan will not install a replacement part if either Heatspan is unable to obtain an acceptable interchangeable or alternate part, or if the removal of the defective part or installation of a replacement part could do damage to the equipment or create unsafe conditions.


• I authorize HEATSPAN to charge my first and all future payments at the frequency specified to my checking account or credit/debit card and my financial institution to debit these payments from my checking account or credit/debit card. After the initial 12 month introductory period, my coverage will be renewed at the then current price in effect at the date of my renewal. This authorization is to remain in effect until HEATSPAN receives notification of change or cancellation by Customer’s written notice of cancellation which must be sent to the following address: Heatspan Customer Care, 1980 east 35th street BKLYN N.Y. 11234 . Prices include sales tax. All Start up an Shut down Maintenance are to be scheduled by the customer. Start up Maintenance is done only by appointment between July 31 - October 1.Shut Down Maintenance is done only by appointment between April 1 - May 31.
